Allahabad HC Grants Bail To Man Accused Of Sending Derogatory Email Against UP CM Yogi Adityanath

The Allahabad High Court has granted bail to Mubarak Ali, who has been in jail since March 20, 2024, in a case involving allegations of sending an email containing derogatory remarks against the Uttar Pradesh Chief Minister Yogi Adityanath.

Justice Krishan Pahal passed the order on September 3, taking into account Ali's period of incarceration, the pace of the trial and the material on record.

Ali is accused in a 2024 case registered at Bhitauli police station in Maharajganj under Sections 153A, 295A, 505(2), 504, 419, 420, 467, 468, 471 and 120-B of the IPC and Section 66 of the Information Technology Act.

Allegation Of Derogatory Email Against UP Chief Minister

According to the allegations recorded in the judgment, Ali had sent an email containing derogatory remarks against the Uttar Pradesh Chief Minister in an alleged attempt to settle his case with the police informant, Jannatunnisha.

Ali's counsel denied the allegations and submitted that he had been falsely implicated. He also disputed the allegation that he had used a certain mobile number connected with the case.

The counsel told the court that Ali had one criminal case in his history, but that the same had been explained. He further submitted that Ali had remained in custody since March 20, 2024, and that the trial was proceeding at a "snail's pace".

The State opposed the bail application.

Slow Pace Of Trial

The high court had called for a status report on the progress of the trial. According to the report dated July 23, 2026, only four witnesses had been examined.

Court also records that there were 26 witnesses yet to be earmarked in the final report or charge sheet.

Court specifically considered the applicant's period of incarceration and the pace at which the trial was proceeding.

It observed: "if a case for bail is otherwise made out, an accused cannot be kept incarcerated solely on account of his criminal antecedents"..

Court noted that Ali's criminal history had been "properly explained".

Bail Granted With Conditions

After considering the submissions of both sides, the evidence on record, the period of incarceration and the speed of the trial, court said it was "prima-facie" of the view that Ali had made out a case for bail.

Court accordingly allowed the bail application.

Ali has been directed to furnish a personal bond and two sureties of the like amount to the satisfaction of the court concerned. His release is subject to verification of the sureties.

The high court also directed him not to tamper with evidence or intimidate witnesses and to appear before the trial court as and when required.

It made clear that any breach of these conditions could result in cancellation of bail.

Court also clarified that its observations while granting bail would not affect the trial court's independent assessment of the evidence and testimony of witnesses.

The high court said its order was passed "without expressing any opinion on the merits of the case".
