Allahabad High Court seeks immediate report after serious allegations of lawyer and litigant threats surface during a Lucknow civil appeal hearing

Court said claims of intimidation, if true, raise serious concerns about safety and disruption of justice

The Allahabad High Court has sought a factual report from the District & Sessions Judge, Lucknow, after a litigant and his lawyer alleged they were threatened and intimidated during the hearing of a pending civil appeal before a district court.

Court said the allegations, if correct, raise serious concern about disruptions to the justice system and the safety of litigants and counsel inside court premises.

"In case if the allegations made in the present petition are accepted as correct on its face value then it is a matter of serious concern that such incidents are taking place causing interruption in the dispensation of justice, thus giving bad name to the justice delivery system," the bench of Justice Syed Qamar Hasan Rizvi observed.

The case relates to a civil appeal filed in 2014, which is being heard by the Court of Additional District Judge-7, Lucknow. The matter was listed on August 26, 2025. According to the transfer application filed before the High Court, the counsel appearing for the appellant, Advocate K.K. Dwivedi, was allegedly threatened by private parties involved in the case and was pressurised to withdraw his Vakalatnama. The advocate subsequently withdrew from the matter.

The applicant further alleged that he himself was confronted and threatened by another advocate and his associates, who allegedly asked him not to pursue the appeal. The applicant said that he has reported the incident to the District & Sessions Judge, the Bar Council of Uttar Pradesh and the local police station, and placed copies of these complaints before the High Court.

The High Court issued notices to the private opposite parties and directed the Additional Chief Standing Counsel appearing for the state to immediately communicate the order to the District & Sessions Judge, Lucknow.

The District Judge has been asked to obtain a report from the concerned court and submit his opinion along with any action taken before the next date of hearing.

The matter will be heard next on November 28, 2025.
