Allahabad High Court Grants Bail to Man Accused of Supporting Hamas in Twitter Post

Synopsis

As per the allegations, the accused used his X (formerly Twitter) account to voice support for the terrorist group Hamas and expressed resentment toward the Indian government for backing Israel

The Allahabad High Court, on September 3, 2024, granted bail to Gosh Mohammad, who is accused of supporting the terrorist organization Hamas and opposing the Government of India's stance on Israel through his X (formerly Twitter) account.

As per the allegations, following Mohammad's social media post, tension arose in Singhai village in Murawan. Mohammad was charged under Sections 505(2) of the IPC and Section 67 of the Information Technology Act.

Despite the serious nature of the allegations, the bench of Justice Sameer Jain observed that the offences alleged against Mohammad were triable by a Magistrate First Class, with a maximum punishment of three years

Court also noted that Mohammad had no prior criminal history and had been in jail for more than 10 months since his arrest on October 20, 2023.

While the prosecution opposed the bail plea, it could not contest the fact that the offences carried a relatively light sentence and that Mohammad had already spent a significant amount of time in custody.

Court ordered that Gosh Mohammad be released on bail, subject to certain conditions, including regular court appearances and a prohibition on engaging in criminal or anti-social activities.

Court emphasized that its decision was based solely on the bail application and should not influence the trial proceedings.
