Allahabad HC Grants RCB's Yash Dayal Interim Protection in False Promise of Marriage Case

The Allahabad High Court on July 15, 2025, granted interim protection from arrest to Indian cricketer Yash Dayal, who is facing allegations of sexual exploitation under the pretext of marriage.
The bench of Justice Siddhartha Varma and Justice Anil Kumar passed the order while hearing Dayal’s plea to quash the FIR lodged against him under Section 69 of the Bharatiya Nyaya Sanhita, 2023.
The FIR, registered on July 6, 2025, at Indrapuram Police Station in Ghaziabad, accuses Dayal of physically exploiting the informant over a period of five years after allegedly making a false promise of marriage. The case was filed shortly after Dayal's selection to the Indian Cricket Team.
Senior Advocates appearing for the petitioner argued that the relationship was consensual and spanned half a decade, during which Dayal provided both emotional and financial support to the informant. They submitted records of financial transactions to the court and contended that no element of deceit, as defined under Section 69 of the BNS, was present in the case.
The petitioner’s counsel further argued that the timing of the FIR, coming immediately after his national team selection, pointed towards an intent to extort money and tarnish his public image.
On the other hand, the Additional Government Advocate, appearing for the State, maintained that the FIR disclosed that the petitioner had continuously exploited the informant and even introduced her to his family members under the pretext of marriage. This conduct, the AGA argued, reflected that the promise may have been deceptive in nature.
According to Section 69 of the BNS, a false promise to marry qualifies as an offence only if it is made without the intent to fulfil it and is used as a tool for obtaining sexual consent. Court noted that at this preliminary stage, it was difficult to ascertain whether any such promise was made or, if made, was false from the inception.
After hearing both sides, court observed that the matter required consideration, especially in light of the prolonged nature of the relationship. It issued notice to the informant and directed the State to file its counter affidavit within three weeks. Dayal has been granted interim protection from arrest till the next date of hearing or till the submission of the police report, whichever is earlier.
