Allahabad HC issues notice in plea for ASI survey of Gyanvapi Wuzukhana

Synopsis

One of the main plaintiffs in the Shringar Gauri suit Rakhi Singh has moved the high court against rejection of her application for the ASI survey of the Wazukhana area at Gyanvapi by Varanasi District Judge

In a civil revision plea moved seeking direction for Archeological Survey of India (ASI) survey of the Wazukhana of the Gyanvapi complex, the Allahabad High Court today issued notice to Anjuman Intezamia Masjid Committee.

The bench of Justice Rohit Ranjan Agarwal passed the order.

One of the main plaintiffs in the Shringar Gauri suit Rakhi Singh moved the high court through Advocate Saurabh Tiwari against the rejection of her application for the ASI survey of the Wazukhana area at Gyanvapi by Varanasi District Judge.

The Varanasi court had rejected the ASI survey request for the Wazukhana , citing a Supreme Court order dated May 17, 2022.

The Supreme Court instructed the proper protection of the area where the 'Shiva linga' was reportedly discovered, and hence, directing the ASI to conduct a survey would be deemed a violation of the its order, the local court had held. 

A Shivlingam-like structure was found inside the Wazukhana of the Gyanavpi complex on May 16, 2022, during a survey by the court-appointed commission.

It is the Hindu plaintiffs' claim that the structure found inside the Wazukhana of the mosque complex is a Shivalingam, however, the claim is contested by the Muslim side who argue that it is actually a non-functioning old fountain.

Notably, on August 3, 2023, the high court allowed the ASI survey of the Gyanvapi premises except the Wazukhana area.
