Allahabad HC Orders Probe Into Misconduct of SHO Accused Of Mistreating Women, Assaulting Elderly Man at Police Station

Synopsis

The allegations against the SHO were that when petitioner women went to the police station for their statements to be recorded, misbehaved with them. The entire video of the incident was recorded by one of the petitioners

The Allahabad High Court recently directed the Superintendent of Police, Sultanpur to conduct an inquiry regarding the allegation of misbehavior by a Station House Officer (SHO). 

A plea was moved before the high court alleging that Pradeep Kumar Yadav, SHO Kurebhar, District- Sultanpur had misbehaved with the petitioner women and he had also badly beaten one of the petitioner woman's father at the police station. 

Before the court, the petitioner women submitted that they had also recorded the incident on their camera. 

The bench of Justice Sangeeta Chandra and Justice Narendra Kumar Johari noted that the petitioner women were themselves accused in an FIR dated June 21, 2023, registered under Sections 353, 504, 506 and 34 of the IPC at the Kurebhar Police Station, Distt. Sultanpur.

The petitioners had challenged the said FIR in another writ petition which was disposed of by the high court by giving protection to the petitioner in the light of the directions given by the Supreme Court in the case of Arnesh Kumar v. State of Bihar, (2014).

The allegations impugned in the present writ petition were that when they went to the police station for their statements to be recorded, SHO Kurebhar, District-Sultanpur misbehaved with the petitioners, and the entire video of the incident was recorded by one of the petitioners.

Taking note of the same, court asked the Additional Government Advocate (AGA) to seek instruction in the matter from SP, Sultanpur.

While conducting the enquiry, court directed, that SP, Sultanpur will also examine the CCTV footage, if any, of the Kurebhar Police Station before giving some instruction to the AGA.

The matter will be next heard on September 26, 2023.
