Allahabad High Court Stays Coercive Action Against Lawyer Over Social Media Post Against 'Brahmin Community'

Synopsis

A prayer was made in the FIR that action be taken to stop the accused lawyer from making such post

In an interim order, the Allahabad High Court recently stayed any coercive action against Barsatu Ram Saroj, a practicing lawyer, in connection with an FIR lodged over allegations that Saroj made indecent posts regarding the Brahman community on his social media account.

The FIR was registered on September 26, 2024, under Section 353(2) of the B.N.S. and Section 67 of the Information Technology Act, 2000, at the Line Bazar Police Station in Jaunpur district.

Saroj, who was formerly a member of the Bar Association in Jaunpur, argued through his counsel that the FIR was motivated by malafide intent, particularly pointing out his expulsion from the Bar Association as a potential reason for the complaint.

His counsel contended that the FIR lacked specifics regarding the nature of the allegedly offensive post.

The bench comprising Justices Arvind Singh Sangwan and Mohd. Azhar Husain Idrisi found merit in the petitioner’s plea for consideration.

Court issued notice to the respondents (state government and private persons) and posted the matter to be heard next on February 7, 2025. Until then, the court has directed that no coercive measures be taken against Saroj in relation to the FIR.
