The Allahabad High Court directs ADG Varanasi to appear in person in a police officer's alleged extortion case

Court finds CBCID cop accused of extortion being shielded; orders ADG Varanasi to personally appear and monitor probe

The Allahabad High Court has summoned the Additional Director General (ADG) of Police, Varanasi, to personally appear before it after finding that a CBCID head constable accused of extortion was allegedly being shielded by the police.

The bench of Justice Ajay Bhanot and Justice Garima Prashad passed the direction while hearing a writ petition filed by Head Constable Randhir Singh and another accused, both facing serious allegations of forcibly taking 40 blank signed cheques and five blank signed papers from a man and then using them to extort money through repeated cheque dishonour cases.

According to the FIR, the accused, including Randhir Singh, posted with the CBCID in Varanasi, had extracted the cheques under coercion from the informant. These cheques were later allegedly circulated among associates and repeatedly presented in banks, only to be dishonoured. The purpose, as per the informant, was not recovery of any legitimate dues but to draw him into endless litigation and financially ruin him through extortionate tactics.

Court noted that the allegations disclosed grave offences that required an independent and impartial probe. “The offences disclosed in the FIR are grave enough and warrant independent investigations,” the bench observed, indicating its dissatisfaction with the manner in which the police had been handling the case.

During the hearing, the court recorded its displeasure that despite earlier directions issued on September 25, 2025, the Additional Government Advocate had not received any instructions from the local police authorities. This, the bench said, raised a “prima facie” impression that the petitioner, a serving police officer, was exercising influence over the investigation.

“Prima facie it appears that the petitioner exercises considerable influence over the investigating authorities and the police authorities are apparently covering up for the same by failing to provide the requisite instructions to the Government Advocate,” the court remarked in its order.

Taking a stern view, the bench directed the ADG, Varanasi, to appear before the court in person and submit a detailed affidavit outlining the progress of the investigation. Court further ordered that the ADG must personally monitor the investigation “on a regular basis,” ensuring that no undue influence is exerted by any party.

Significantly, court also vacated the interim protection earlier granted to the petitioners. The bench said that continuing the interim order would “hamper the police investigations,” thereby clearing the way for unhindered inquiry into the allegations.

The case has been listed for further hearing on December 10, 2025.
