Allahabad High Court Denies Bail To Muslim man Posing As Hindu to Lure Hindu Woman For Religious Conversion

The Allahabad High Court has recently denied bail to one Imtiyaz Ansari who is accused of luring a Hindu girl under the false pretense of being Hindu himself, and subsequently trying to convert her to Islam.

The bench of Justice Rohit Ranjan Agarwal highlighted the gravity of the accusations against Ansari, which include charges under Sections 420, 467, 468, and 471 of the Indian Penal Code (IPC) and Sections 3/5(1) of the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act, 2021.

According to the prosecution, Imtiyaz Ansari of Ladpur Usmanpur allegedly fabricated a false residence certificate for the girl, Kumkum. This was done with the help of the Village Pradhan, Nargis Khatoon, and her husband Taslim. The falsified documents misrepresented Kumkum as a Muslim living in Ladpur Usmanpur and named her father as Imtiyaz Ahmad.

The Additional Advocate General stated that Kumkum is the daughter of Gopal Nagar and Sushma Devi, residents of Rajasthani Camp, House No. 22, Sarita Vihar, New Delhi. As per her statement recorded under Section 161, she completed her senior secondary education at a government school in Delhi and worked at a factory in New Delhi, where she met Ansari. He allegedly concealed his Muslim identity by wearing a sacred red thread on his wrist.

The prosecution further revealed that Ansari took Kumkum to his parental home in Ladpur Usmanpur, District-Bareilly. There, she discovered his true religious identity and learned that the documents regarding her domicile were fabricated in collusion with the Village Pradhan.

The Additional Advocate General also argued that Kumkum was being converted to Islam under false pretenses, supported by the falsified and fabricated documents.

The high court noted that it was clear from the statement of the girl recorded under Section 161 CrPC that Ansari convinced her that he was a Hindu by religion and when she was brought to his native village she was shocked to know that he was Muslim by religion.

"In the instant case, the applicant had misrepresented himself by fraudulent means, that he was a Hindu by religion, while working at private factory in Delhi and persuaded the girl to come to native village where the documents were prepared for her conversion to Muslim religion. This Court finds that no case for bail is made out," court ordered.
