'Infructuous': Madras HC dismisses Felix Gerald’s Pre-arrest bail plea

Synopsis

Gerald conducted an interview with 'Savukku' Shankar where Shankar made derogatory remarks against female police officers. The Tiruchi police arrested Gerald in Noida on May 10 and soon after the Coimbatore police made a formal arrest in the its case too, when Gerald was in prison on May 15

The Madras High Court on May 16, 2024, dismissed the anticipatory bail plea of Felix Gerald of the RedPix YouTube channel as infructuous. The plea was filed in a case by Coimbatore cyber crime police regarding Gerald's interview with 'Savukku' Shankar, who allegedly made derogatory comments about female police personnel.

Gerald, along with 'Savukku' Shankar, faces charges under multiple sections of the Indian Penal Code and the Tamil Nadu Prohibition of Harassment of Women Act of 1988.

The bench of Justice R. Sakthivel was apprised by the Additional Public Prosecutor R. Muniyapparaj that the Tiruchi police had arrested Gerald in Noida on May 10, in a similar case booked by them.

Moreover, the Coimbatore police had made a formal arrest in its case too, when Gerald was in prison on May 15.

The APP also presented orders issued by the jail superintendent regarding the formal arrest made within the prison premises.

Taking note of this submission, the judge dismissed the anticipatory bail plea filed by Gerard as infructuous as it was filed before his arrest during the summer vacation court last week.

While dealing with Gerald's pre-arrest plea last week, Justice K. Kumaresh Babu had orally observed that certain YouTube channels prioritize subscriber growth over decency by disseminating offensive content. They have become a menace to the society, he had said.

The judge had stressed that it is high time for governmental intervention to curb such harmful activities.

The APP had then argued that it was Gerald who had conducted the interview with 'Savukku' Shankar and therefore it was him who 'facilitated' Shankar to make such controversial statements.
