The Bombay High Court on Thursday directed an expedited magisterial inquiry into the death of Akshay Shinde, the cleaner accused in the Badlapur sexual assault case.

The report shall be placed before us on November 18. The magistrate inquiry report is expedited,” the order reads.

A division bench of the high court comprising Justice Revati Mohite Dere and Justice P.K. Chavan was hearing a petition filed by the father of Akshay Shinde, alleging that his son was killed to protect other persons involved in the case.

Akshay Shinde was killed in an encounter on Monday while being taken from the court by the police. Shinde allegedly pulled out the revolver of an officer and fired three rounds. Subsequently, one of the officers shot Shinde.

The bench asked for the inclusion of strong forensic evidence in the probe into the incident where Shinde was killed.

Advocate General Birendra Saraf, representing the police, informed the bench that all the relevant documents had been forwarded to the magistrate for the inquiry.

The high court expressed its displeasure upon learning that the police had not seized the bottle of water given to the accused when he requested water in the vehicle.

The court also questioned whether a medical examination of the police officer who was shot had been conducted.

“The police officer who sustained gunshot injury. Has he been examined properly? Was there any residue or blackening at the spot? We need to see that. Was there an entry and exit wound on the thigh of the police officer who got hurt? We need to see his injury certificate. The bullet injury must also be having some residue to correlate which gun's bullet hit him,” the court said.
