The Bombay High Court on Monday pulled up the State CID for taking lightly the probe into the killing of the accused in the Badlapur Sexual Assault Case.
A division bench of the high court, comprising Justice Revati Mohite Dere and Justice P.K. Chavan, was hearing a petition filed by Shinde's father, who alleged that his son was killed to protect other individuals involved in the case.
Shinde was killed in an encounter on Monday while being transported from court by the police. He allegedly snatched an officer's revolver and fired three rounds, after which another officer reportedly shot him.
The bench questioned how the State CID could take the case of custodial killing so lightly. The bench also remarked that the CID’s conduct was increasing suspicion in the matter.
“Why is the CID not collecting information properly and why are we forced to test it? Don't test our patience now. Medical papers are not collected. Are you deliberately trying to withhold information from the magistrate?” the bench asked.
The bench has posted the matter for further hearing on January 20, 2025.
Earlier, the bench questioned the approach of the investigating agency for not collecting Akshay Shinde’s fingerprints from the water bottle given to him before the encounter, describing it as unusual.
The high court emphasized that all relevant material should be adequately presented before the magistrate to facilitate a proper inquiry into the encounter.
Expressing displeasure over delays by the investigating agency, the bench noted that the police were still recording witness statements. Consequently, the bench directed the report to be submitted to the magistrate within two weeks.
