[Banning Dussehra Animal Sacrifice] “How can you approach us one day before Dussehra?” – Bombay HC

Synopsis

Justice Varale and Justice Borkar came down heavily on a lawyer when the lawyer approached the court one day before the Dussera for a ban on sacrificing animals.

A Division Bench comprising Justice P.B Varale and Justice N.R Borkar of Bombay High Court came down heavily on a lawyer who mentioned a case against the order passed by Justice S.V Gangapurwala and Justice R.N Ladha after the State Government’s submission that animal sacrifice would be allowed at Saptashrungi Temple without gun firing as a salutation.

The Bench questioned the lawyer that “How can you approach us one day before Dussehra?”.

Justice P.B Varale told the lawyer that “Such practice is being carried out in other temples also. Is this the way you approach us one day before Dussera?”

The lawyer then submitted before the court that they are in the process of filing the petition and requested the court to grant production.

The bench told the lawyer that “This practice and celebration is done every year in different temples and not just in one or two states, it is done throughout the nation”

Justice P.B Varale while rejecting the submissions of the lawyer said that the lawyer could have approached the court earlier that there will be a law-and-order situation and that the entire machinery was put in place for the celebration of Dussehra after 9 days of Navratri.

An Advocate on Record accompanying the lawyer tried to argue that animals are being sacrificed and that it is an environmental issue. However, the bench asked the lawyer to approach the court early next year.
