The high court asked counsel for both sides to have a discussion on children’s education and future plan.

Bollywood Actor Nawazuddin Siddiqui has approached the Bombay High Court seeking the whereabouts of his children who are in custody of his wife. Siddique has filed a habeas corpus petition before the high court which was heard by a division bench of Justice AS Gadkari and Justice PD Naik.

Advocate Pradeep Thorat for Siddique informed the court that Siddique’s estranged wife is a citizen of UAE and he has received emails from the school wherein he has been informed that his children are missing from school and will be rusticated.

He submitted that he had divorced his wife in 2011 through a Khulanama and that there were no separate proceedings other than a plea filed by her wife for quashing the complaint which was filed by her mother-in-law.

Advocate Rizwan Siddique for the wife submitted to the court that the children are in the wife’s custody and are in India. He informed the court that the daughter wants to stay in India and does not want to live in any other country. He said that both the children want to study online or enroll in India.

When Advocate Rizwan Siddique said that Nawaz is relying on the Khulanama which is being disputed by the wife, the court said that it is a habeas corpus petition and has a very limited scope.

The court said that Siddiqui was only concerned about the whereabouts and the education of the children. The court then asked Advocate Rizwan to have a discussion with Advocate Thorat about the children’s education and future plans.

The court then posted the matter next week for further hearing.
