Bombay HC Forms Committee For Reconstruction And Repair Of Roads In Aarey Colony

The high court in its order recorded court directed the committee to assess and suggest a comprehensive plan for the repair and reconstruction of the roads, taking into consideration all environmental concerns

The Bombay High Court, headed by Chief Justice Devendra K Upadhyaya and Justice Arif Doctor, has constituted a committee to propose a roadmap for the reconstruction and repair of approximately 45 kilometres of roads in the Aarey Colony.

The Bombay High Court was addressing a Public Interest Litigation seeking directions to the authorities for the repair and maintenance of roads in Aarey Colony.

The bench acknowledged the complexity of the matter and emphasized the need for a comprehensive report from the committee to address the issues involved.

“Having regard to the nature of issues involved in these petitions, we are of the opinion that a comprehensive holistic report from a Committee, to be constituted by this Court, be called for so that the problems being faced by the residents of Aarey Milk Colony, as also the environmental concerns may be addressed,” the court observed.

The division bench constituted a committee comprising the Secretary of the Dairy Development Department, the Secretary of the Department of Forest, the Secretary of the Public Works Department, the Chief Engineer (Roads) from the Municipal Corporation of Greater Mumbai, a senior-level expert in environmental protection from the National Environmental Engineering Research Institute, and the Chief Executive Officer of Aarey Milk Colony.

The high court directed the committee to assess and suggest a comprehensive plan for the repair and reconstruction of the roads, taking into consideration all environmental concerns, including whether any of the roads fall within the Eco-Sensitive Zone.

The bench further ordered the committee members to conduct the survey promptly and submit their report to the court by the next scheduled hearing.

The bench while directing repair work on the road from Aarey Market to Mayur Nagar asked the state government to provide funds.

“Repair would not mean reconstruction of the road using concrete. Since the repair work of this road, which is 1.5 Km. in length will require some funds, we direct that necessary funds shall be provided by the State Government in the concerned department,” the court directed.

The high court has kept the matter for hearing on 13 September 2023.
