Bombay High Court Denies Bail to Man Booked For Sexually Exploiting Woman through Matrimonial Websites

The Bombay High Court has recently denied bail to a man who was booked for rape of a woman who met on a matrimonial website.

A single-judge bench of the high court comprising Justice JM Jamadar was hearing a bail application filed by Deepak Dayanand Suvarna who was booked for rape under the Indian Penal Code.

On 30th September 2022, Deepak called the victim at Daffolidies Restaurant, Kandivali. After they had drinks and dinner, Deepak took her to a lodge at Dahisar and had sexual intercourse with her without her consent.

On the next day, the applicant again took her to another lodge at Goregaon and after sexually exploiting her, the Deepak raked up a quarrel with her. Somehow the victim managed to run away and apprise her sister about her ordeal. Later, an FIR was filed.

Deepak contended that the relationship was consensual. He added that as the relationship turned sour, he has been falsely roped in. It was also submitted that Deepak and the victim were in a relationship and they had physical relations on multiple occasions.

The bench was informed that about 25 days before the alleged occurrence, Deepak allegedly made inquiries with the victim's mother identifying himself as Rajiv Pujari and also exchanged numbers.

Furthermore, the bench was appraised that other cases filed against Deepak were of similar allegations.

The bench observed that in the other case, Deepak was released on bail in the said case on 12th August 2021 and hardly a year had elapsed, when Deepak came to be prosecuted in another case, with similar allegations.

While denying bail to Deepak noted that Deepal had resorted to the modus operendi of sexually exploiting unsuspecting ladies by approaching them on the pretext of matrimonial alliances cannot be brushed aside lightly.

“If viewed in the context of antecedents of the applicant, the submissions of Mr. Dedhia that the applicant had resorted to the modus operendi of sexually exploiting unsuspecting ladies by approaching them on the pretext of matrimonial alliances cannot be brushed aside lightly. This factor dissuades the Court from exercising discretion in favour of the applicant,” the order reads.
