Following pleas by the Shree 1008 Digambar Jain Mandir Trust against the Bombay Municipal Corporation (BMC), the Bombay High Court recently ordered to halt additional demolitions of the Jain temple in Vile Parle.
Justice Gauri Godse granted the temple ad-interim protection, highlighting the appellants entitlement to a hearing on their appeals and a reasoned order.
The Bombay Municipal Corporation’s demolition activities, which were based on notices issued under the Mumbai Municipal Corporation Act, 1888 and the Maharashtra Regional and Town Planning Act, 1966, gave rise to the given controversy.
The Trust's request for temporary protection had previously been denied by a city Civil Court, however, a seven-day stay was granted ending on April 15.
It was informed during the hearing that while the temple's main structure was still standing, a portion of it had been destroyed.
The Court directed BMC to submit an affidavit and a demolition panchanama within a period of two weeks. The appellants will have ad-interim protection till further notice, Court said.
During the proceedings, Senior Advocate Surel Shah represented the Shree 1008 Digambar Jain Mandir Trust, while Advocate Drupad Patil represented the BMC. The Corporation’s counsel agreed to maintain all communications with the relevant officer regarding the demolition status, confirming that most of the structure has already been demolished except for two walls.
The matter is next listed for hearing on April 30, 2025.
