The Bombay High Court on Monday dismissed a writ petition challenging the contract awarded to Adani Transmission for the supply of renewable and thermal power electricity in the state of Maharashtra.

A division bench of the high court comprising Chief Justice Devendra Upadhyaya and Justice Amit Borkar was hearing a petition filed by Shriraj Nageshwar Aepurwar challenging the 6600 MW contract awarded to Adani.

While dismissing the civil writ petition, the high court imposed a cost of Rs. 50,000 on the petitioner and noted that the petition contained unsubstantiated and reckless allegations.

"In our opinion, filing of such petition containing unsubstantiated and reckless avermemts have the risk of sometimes good causes being lost," the bench said.

Advocate Anand Jondhale, representing the petitioner, also alleged that the former Chief Minister of Maharashtra, Eknath Shinde, was hand in glove with Gautam Adani, and therefore, the contract was awarded to Adani Transmission.

The petitioner also relied on a document containing corruption charges allegedly filed against Gautam Adani in the United States of America. However, the bench observed that the petitioner's counsel "utterly failed" to clarify the nature of the document.

Accordingly, the bench proceeded to dismiss the petition while noting that...

"The writ petition, in our opinion, is highly misconceived being based on completely unsubstantiated assertions which are not supported by any material or document," the order states.
