Calcutta HC Dismisses plea Against CM Mamata Banerjee Over Her Alleged Provocative Speeches Against Central Govt During Ramadan

The plea had that CM Banerjee used the religious forum for political gain by giving provocative speeches against the Ruling Party at the Centre and also provoked the Muslims present there during the Holy occasion.
The Calcutta High Court has dismissed a plea filed against West Bengal Chief Minister Mamata Banerjee for allegedly using a religious forum for political gain by giving provocative speeches against the ruling party in the Centre while attending a religious congregation on the occasion of Eid-Ul-Fitr.
A division bench of Chief Justice Prakash Shrivastava and Justice Rajarshi Bharadwaj said, "we find that no authentic material has been enclosed with the public interest petition to substantiate the plea raised in the petition."
The petitioner, Nazia Elahi Khan had submitted that in Eid Ki Namaz only Muslims can enter mosque in order to offer the prayer but on May 3, 2022, Chief Minister Mamata Banerjee, on the occasion of Eid-Ul-Fitr had entered the religious congregation and made political speech.
Whereas, the Counsel appearing for the Calcutta Khilafat Committee submitted that since 1970 the Chief Ministers of the State are attending Eid-Ul-Fitr and Eid-Ul-Adha prayers and that not only Muslim women but Hindu women also can participate in that prayers.
In view of the above, the bench had dismissed the plea due to lack of authentic material.
The plea had alleged that Banerjee used the religious forum for political gain by giving provocative speeches against the Ruling Party at the Centre and also provoked the Muslims present there during the Holy occasion.
The plea had sought direction for the Government to furnish a report in the form of an affidavit regarding the legality of Banerjee's entry into the religious congregation of the Red Road Namaz during Eid Ki Namaz on the Holy and Solemn occasion of Eid-Ul-Fitr.
The plea had further sought direction prohibiting Banerjee from entering the religious congregation of Red Road Namaz on the occasion of Eid-Ul-Fitre in the subsequent years.
Additionally, it had sought direction to the State Government to ensure that no political speeches are given in a religious congregation in the future by Banerjee.
