Calcutta High Court asks Police to investigate into complaint against Srijato Bandyopadhyays poem allegedly hurting Hindu sentiments

The plea sought an investigation into a complaint against Poet Srijato Bandyopadhyay for allegedly hurting Hindu sentiments by stating in his poem that condoms will be put over the Trishul.

The Calcutta High Court on Friday directed the Deputy Commissioner of Police, Detective Department, Bidhannagar Police Commissionerate to investigate into a complaint against poet Srijato Bandyopadhyay over his poem posted in 2017 allegedly with derogatory, anti-feminine, anti-religious statements.

A bench of Justice Rajasekhar Mantha has asked for a report to be submitted on the investigation conducted before the next date of hearing.

The plea has been filed by one Biplab Kumar Chowdhury alleging that no action has been taken by the Police on a complaint filed in 2017 against Bandyopadhyay. A complaint was filed against his poem alleging that it is illegal, deregulatory, anti-feminine, and against the public policy and religious sentiments of people.

It was stated that the poem was posted on Facebook which stated, "condom will be put over the Trisul of religion when you will try to rape me by raising me from the graveyard."

The complaint argued that the poem is a direct insult to the religious beliefs of Hindus and is a ploy to obtain cheap publicity.

In view of the above, the plea submitted that to date no steps have been taken by the police authorities to investigate the allegations made in the FIR in as much as neither the complainant nor the witnesses have ever been interrogated by the police officers nor their statements have been recorded under section 161 of the Code of Criminal Procedure.

The Court has directed the matter to be listed on November 17, 2022.
