Centre Notifies Transfer of Three High Court Judges, Appointment of 5 Permanent Judges at Allahabad HC

The transfers and the appointments were recommended by the Supreme Court Collegium led by the Chief Justice of India DY Chandrachud and also Comprising Justice Sanjiv Khanna and Justice BR Gavai

The Ministry of Law and Justice (Department of Justice), has notified the transfer of two Judges namely, Justice Sujoy Paul and Justice Moushumi Bhattacharya to Telangana High Court. While Justice Anu Sivaraman has been transferred to the High Court of Karnataka. Additionally, the names of five additional judges were cleared for appointment as Permanent Judges at the Allahabad High Court.

Justice Sujoy Paul of the Madhya Pradesh High Court has been transferred to the Telangana High Court based upon his request on the grounds that his son is practicing in the High Court of Madhya Pradesh.

While, Justice Moushumi Bhattacharya, serving in the Calcutta High Court has also been transferred to the Telangana High Court, acceding to her transfer request citing personal reasons.

The Supreme Court Collegium led by the Chief Justice of India DY Chandrachud and also Comprising Justice Sanjiv Khanna and Justice BR Gavai, recommended the transfer of both the judges by a resolution dated February 13, 2024, for the better administration of justice to Telangana.

Their joining will take the current judge strength of Telangana High Court to 28. The high court is, however, still short of 11 judges as the sanctioned strength is 42.

Justice Anu Sivaraman, currently serving in the Kerala High Court, was recommended for transfer to the High Court of Karnataka by the Supreme Court Collegium. Her transfer request was made in a communication dated October 16, 2023, seeking a transfer out of the state of Kerala. The same was also notified by the Centre.

According to the notification these transfers have been made, “In exercise of the power conferred by clause (1) of Article 222 of the Constitution of India, the President, after consultation with the Chief Justice of India” and the Judges are directed to assume charge of their respective offices.

Additionally, the names of Five Additional Judges were cleared for appointment as Permanent Judges at the Allahabad High Court.

The notification stated, “In exercise of the power conferred by clause (1) of Article 224 of the Constitution of India, the President is pleased to appoint”

“ Additional Judges of Allahabad High Court, to be Judges of that High Court with effect from the date they assume charge of their respective offices.”

The Chief Minister and the Governor of the State of Uttar Pradesh having concurred to the recommendations, the Collegium recommended the names of these five judges by a resolution dated March 12, 2024. The decision, made after thorough scrutiny and evaluation of all relevant materials such as recent judgments and considering the report of the Judgment Assessment Committee.

The central government has accepted and endorsed the decision of the SC Collegium on March 18, 2024, completing the formal process of appointments.
