Though initially, the advocate for the petitioner agreed to deposit only 50 thousand, subsequently, he informed the court that he was ready to deposit the whole amount from his saving account.
A division bench of the Bombay High Court at Aurangabad comprising Justice Ravindra V Gaughe and Justice Sanjay A Deshmukh has recently asked the petitioner to deposit an amount of Rs. 3 Lakh to prove his bonafide in a plea in which he sought construction of a statue of Chhatrapati Shivaji Maharaj.
The Judicial Registrar had indicated in his remarks that the petition lacked judicial interest before the matter had come up for hearing. The petitioner had claimed that he was heading the ‘Rayatecha Raje Chhatrapati Shivaji Maharaj’ Statue Committee, in the Nanded district and had collected Rs.50,00,000.
The court, to test the bonafide of the petitioner asked him to deposit a sum of Rs. 3 lakhs. The order reads,
“In order to test the bona fides of the petitioner, who prays for the erection of the statue of Chhatrapati Shivaji Maharaj, we direct the petitioner to deposit an amount of Rs.3,00,000/- in this Court.”
However, the advocate for the petitioner informed the court that he was ready to deposit a sum of Rs. 50 thousand only and not Rs. 3 Lakhs.
Subsequently, the petitioner’s advocate submitted that he was ready to deposit Rs.3,00,000 from his own Savings Bank account and not from the amount of Rs.50,00,000 that he had collected from the public at large.
The court then granted him time till February 28, 2023, to deposit the said amount to the court as security.
The court will next hear the Public Interest Litigation on 03 March 2023.
