[Commonwealth Games] Court Can't Select Players For Sporting Events: Delhi High Court

Synopsis

Delhi High Court has observed that selecting sports persons to represent the country in international competitions cannot be done by courts. 

A bench of Justice Dinesh Kumar Sharma has dismissed two petitions filed by two table tennis players - Swastika Ghosh and Manush Shah, who had challenged the exclusion of their names from the list of players selected to represent India in the Commonwealth Games scheduled to be held in Birmingham. 

Justice Sharma agreed with an earlier decision of the Court and held that it cannot appropriate itself in the position of a ‘Super Umpire’ or 'Super Referee’ or ‘Super Selector’.

It was further observed that courts do not have the expertise to venture into the domain of selection and finalisation of players and participation on an international level.

High Court has said that the names of the players had been finalised by the Committee of Administrators appointed by the it, which had examined all the issues and arrived at the decision after taking into account all aspects.

"Only where the findings of the Committee of Administrators is entirely perverse and arbitrary on the face of it, can the court interfere with the same...", said the single judge bench.

Ghosh was represented by Senior Advocate Arijit Prasad and Advocate Keshav Ahuja. Shah, on the other hand, was represented by Advocates Deep Biswas, Shilpa Gamvami and Atmaja Tripathi .
