UP Court awards life imprisonment to man for kidnapping and raping minor

Synopsis

The victim was taken away by a woman who had been paid by the main accused to help him in committing the crime. 

A local court in Uttar Pradesh's Budaun district recently sentenced a 38-year-old man to life imprisonment in a kidnap and rape case of a minor girl in 2015. 

The Special POCSO court also sentenced the 33-year-old woman who was an accomplice in the case to 10 years of rigorous imprisonment for abetment. 

The convicts namely Bunda and Tabassum were booked under Sections 363A (kidnapping or maiming a minor), and 376(rape) of IPC along with the offences punishable under the Protection of Children from Sexual Offences Act, 2012 (Pocso Act) in 2015 and sent to jail.

The incident took place on June 17, 2015, when the victim was 15 years old. A week later on June 24, the victim was rescued. 

It was the prosecution's case that Tabassum was known to the victim and she was the one who handed the victim to Bunda. Thereafter, Bunda took the victim to another place. The prosecution alleged that Bunda kept the victim in Kasganj for nearly a week where she was once raped by him.

Moreover, the victim herself recorded in her statement that Bunda had paid Tabassum to aid him in the crime. 

Additional District Judge Deepak Yadav convicted and sentenced Bunda and Tabassum based on the evidence produced in the court.

As per a news report, the judge, while passing the order, said, "The accused don't deserve any kind of mercy and because of their act, the survivor will remain in trauma of the incident throughout her life".

Further, while stating that the convicts did not deserve any kind of mercy, the court also directed that Bunda has to pay a fine of Rs 60,000, while Tabassum has to pay Rs 30,000 and half of the amount recovered as fine will be given to the survivor.
