CoVID Facility For Lawyers By Bar Council Of Delhi: Delhi High Court Takes Strong Objection Against Advocate Representing Without Authority

The Delhi High Court Bench of Justices Vipin Sanghi & Rekha Palli on Tuesday took strong objection against Advocate Mr Yashvardhan Singh Soam who appeared for Rockland Hospital (currently known as Medeor Hospital) without any authority & submitted for handing over the keys of the said hospital.
The Bench said that it was dismayed that Advocate Mr Yashvardhan Singh appeared without authority & made such statements while hearing a petition preferred by the Chairman of Bar Council of Delhi to seek directions for making arrangements for treatment of Covid- 19 positive Advocates in Delhi.
Sr Advocate Mr Rahul Mehra appearing for NCT of Delhi submitted Advocate Mr Yashvardhan Singh had no authority to hand over the hospital to Bar Council of Delhi.
Advocate Abhishek Singh appearing on behalf of Rockland Hospital sought a modification of the order dated May 3, 2021 submitting that Advocate Mr Yashvardhan Singh Soam misrepresented the hospital & made a false statement on hospital’s behalf.
Sr Advocate, Mr. Ramesh Gupta, in his plea, had submitted that the advocates had identified Rockland Hotel for conversion as a Covid facility. He stated that the expenses for the said conversion would also be borne by the Bar Council and the Advocates. He further submitted that the medical staff, including doctors and paramedics, as well as the equipment to be installed there would also be provided by the Bar Council,and Advocates. He prayed for attachment of the said facility with any existing hospital to deal with the patients who required ICU treatment.
On May 3, 2021 the Bar Council which was willing to provide the medical and para-medical staff and other equipment required for starting of nursing homes/hospital submitted that it was willing to take over Rockland Hospital, Dwarka merely in the capacity of a licensee. It further suggested that the same could be operationalised with the aforesaid medical and para-medical staff, and the management could be undertaken by persons appointed by the Bar Council itself. However, whatever clearances were required for operationalising the hospital be addressed to this Court, so that the said aspect could be examined.
Thereafter, the Court upon Advocate Mr. Yashvardhan Singh Soam’s submission that he was in possession of the keys of the said hospital ordered for handing over the keys to Sr Advocate Mr Ramesh Gupta during the course of the day to enable the Bar Council to inspect the property & take steps to make the facility operational at the earliest.
