Delhi Court grants 60 days interim bail to PFI member to take care of his pregnant wife

Additional Session Judge (ASJ) Sanjay Khanagwal of Patiala House Courts granted bail to a Popular Front of India (PFI) member namely, Saiyad Salluddin on the ground of his wife's pregnancy. Salluddin is accused of various offences under IPC and UAPA.
A Delhi Court on Friday granted 60 days interim bail to a Popular Front of India (PFI) member namely, Saiyad Salluddin on the ground of the pregnancy of his wife, whose delivery is scheduled in mid-November 2022.
Additional Session Judge (ASJ) Sanjay Khanagwal of Patiala House Courts granted bail to Salluddin on furnishing of a personal bond of Rs.50,000.
Salluddin is accused of offences under Sections 120B (Criminal Conspiracy), 153A (Promoting enmity between different groups on grounds of religion, race, place of birth, residence) of the Indian Penal Code and Sections 10 (member of the unlawful association) and 13 (punishment for unlawful activities) of the Unlawful Activities (Prevention) Act (UAPA).
The court noted that as per the verification report the composition of Salluddin's family was verified, and it revealed that his father is about 70 years of age and has a 40% disability. Apart from that, court found that Salluddin has two children aged one year and three years, and even has a sister-in-law but she also has two minor children.
Advocates Mujeeb ur Rehman, Md. Arif Hussain and Satyam Tripathi appearing for Salluddin contended that the whole family fully depends on him for each and every need, and his absence during the time of hardship would ruin their prospects. It was also stated that his wife and yet-to-come newborn baby need urgent attention, care, treatment, and support and the same cannot be provided in Salluddin’s absence.
While granting 60 days interim bail to Salluddin, ASJ Khanagwal also directed him to surrender before the concerned jail superintendent after the expiry of the 60-day interim bail under the intimation of the court.
The Central government on September 28, declared the Popular Front of India (PFI) and the other eight alleged affiliated fronts as ‘unlawful associations’. The fronts which included: Rehab India Foundation (RIF), Campus Front of India (CFI), All India Imams Council (AIIC), National Confederation of Human Rights Organization (NCHRO), National Women’s Front, Junior Front, Empower India Foundation, and Rehab Foundation, Kerala, had been banned for five years.
