Delhi District Courts Establishment Takes a step towards Eliminating Discrimination against PWDs

In lieu of the Right of persons with disabilities Act, 2018 the District courts of Delhi have taken out a circular to ensure compliance and furtherance of the same in the ambit of ‘Equal Opportunities’ enumerated under Section 21 of the Act. It is stated that in terms of accessibility newly constructed court complexes such as Saket and Rouse Avenue Court complex are already in adherence. Furthermore, the travel allowance given to PWD employees is double the regular fixed compensation.
The current circular promises to bring about much needed sensitization and change in the current system. There are special and supportive provisions made for preference in transfer, posting, leave and allotment of residential accommodations.
Furthermore, in terms of equitable accessibility assistive devices, barrier-free accessibility and other provisions such as low vision aids, hearing aids and wheel chairs shall be provided, replenished and keep in good condition every three years.
A special grievance redressal forum shall be provided for the PWD employees to fend off and as a deterrent against any discrimination and/or harassment, and all their information shall be subject to the highest levels of confidentiality to prevent the same.
In terms of disability acquired by an existing employee they shall maintain the rank they were at previously if the said disability does not infringe upon the requirements of the said position. If not, they shall be re-skilled for a job at an equivalent position, if this again is not possible the employee will be posted on superannuation till a suitable post becomes available or till the he/she attains the age of superannuation.
