Delhi HC agrees to hear on July 9 plea seeking modification in CBSE's Tabulation scheme of Class X Board Exams

The Delhi High court today agreed to hear on July 9, plea seeking modification in the Central Board of Secondary Examination's (CBSE) scheme of tabulation of Class 10 Board Exams, after an application for early hearing by the petitioner NGO Justice For All was filed in the Court.
The Division bench of Chief Justice DN Patel and Jyoti Singh after being informed that the CBSE had not filed its response agreed to hear the matter on July 19 directing the CBSE to file its reply.
Earlier the bench led by Chief Justice DN Patel had issued notice in the matter after which it was listed before the vacation bench of Justice C Hari Shankar who recused from hearing the matter.
Seeking a modification in the scheme the petition filed by NGO Justice For All through Advocate Khagesh B Jha and Shikha Sharma Bagga says that "The policy of moderating the average marks assessed by the school, based on the historical performance of the previous average result of the school, in terms of the best overall performance of the school would be injustice to the students as the performance of school not relatable in any manner with the performance of the students."
The petitioners have further said that such scheme is absolutely unreasonable, illogical and punitive for the students of the school which has been appearing in the board exams for the first time, having no historical data of previous year's performance."
The petitioners have said that by bringing in such scheme of tabulation of marks, the CBSE failed to ensure the protection of fundamental right to the students appearing in class 10th Board examination in the year 2020-21, under provisions of Article 19 (1) (a), 21 and 21 A of the Constitution.
