The bail plea filed by Sengar was listed before the division bench of Justices Mukta Gupta and Justice Poonam A Bamba after Justice Talwant Singh had recused himself from hearing the matter.
The Delhi High Court on Monday granted interim bail to Unnao rape case convict and former Bhartiya Janta Party (BJP) MLA Kuldeep Singh Sengar for his daughter’s marriage. Sengar has been sentenced to life imprisonment for raping a minor girl in Unnao District of Uttar Pradesh in 2017.
A bench of Justice Mukta Gupta and Justice Poonam A Bamba granted interim bail to Sengar for his daughter's marriage while raising the concern that the ceremonies for marriage are spread out as Sengar has sought for 60 days' interim bail.
Sengar had submitted that he requires two months of interim bail for attending his daughter’s marriage scheduled for February 8, 2023. He had also submitted that the marriage ceremonies shall begin on January 18.
Through his plea, he had also challenged the Trial Court order dated December 20, 2019, wherein the Tis Hazari court judge sentenced him for the "remainder of his natural biological life" for abducting and raping a minor girl.
Sengar has been convicted under various provisions including Section 376 (2) of the Indian Penal Code which deals with a public servant who takes advantage of his official position and commits rape on a woman in his custody or in the custody of a public servant subordinate to him.
It may be noted that the survivor of the 2017 Unnao rape case moved the apex court for the transfer of the criminal case filed by the father of one of the accused in her sexual assault case from a trial court in Uttar Pradesh to Delhi.
The transfer was sought after a local court in Unnao issued a non-bailable warrant against the victim on a criminal complaint of alleged cheating and forgery filed by the father of Shubham Singh, one of the accused being tried in the Unnao gang rape case in a Delhi court.
