Delhi HC Releases TB Patient on Interim Bail; Lawyer Says Pollution Worsened Breathing Issues

Defence argued the accused, who has tuberculosis, struggled to breathe in custody amid Delhi’s hazardous air quality

The Delhi High Court recently granted interim bail to a tuberculosis patient accused in a murder related case, taking note of his deteriorating health condition exacerbated by the severe air pollution in the capital.

Justice Swarana Kanta Sharma passed the order while dealing with a plea filed by the accused seeking temporary relief in an FIR registered at Paschim Vihar Police Station under Sections 363, 364A, 506, 120B, and 34 of the IPC.

During the hearing, counsel for the applicant informed the court that the accused had earlier been granted interim bail on October 4, 2025, on medical grounds, after being admitted for tuberculosis treatment, and later discharged from the hospital on October 23, 2025. His interim relief was extended once again on October 25, 2025.

It was further submitted that the current pollution levels in Delhi had worsened his breathing condition, posing a serious health risk if he remained in custody.

The State opposed the bail, citing the seriousness of the allegations, but did not dispute the medical diagnosis.

After considering the submissions, the court noted that the applicant’s health condition was undisputed and that he had not violated bail conditions during earlier relief periods.

“Considering the overall facts and circumstances of the case,” the court held, granting him 15 days of interim bail on furnishing a personal bond of Rs 15,000 with one surety.

The Court imposed conditions including regular appearance before the trial court, restriction on travel outside India, and a direction not to contact witnesses or tamper with evidence. It clarified that the relief was being granted solely on medical grounds and should not be construed as a reflection on the merits of the case.
