Delhi HC Issues Notice on Leena Pauloses Plea for Private TB Treatment in Custody

Paulose has moved High Court seeking medical treatment after being diagnosed with tuberculosis

The Delhi High Court has recently issued notice on a plea filed by actor Leena Paulose, wife of alleged conman Sukesh Chandrasekhar, seeking medical treatment at a hospital of her choice.

Paulose, who is currently in judicial custody in a money laundering case, has been diagnosed with Tuberculosis.

A bench led by Justice Renu Bhatnagar issued notice to the prosecuting agencies and listed the case for further hearing on July 2. It may also be noted that her bail plea in the money laundering case is listed on the same day.

In her plea, she has sought directions to avail in-custody private medical treatment and diagnosis at a hospital of her choice, contending that adequate treatment is not feasible within the jail premises.

Appearing for Paulose, Advocate Anant Malik, along with Advocates Paul John Edison and Tanya Sharma, informed the court that she is a 42-year-old woman who has been diagnosed with a serious disease like tuberculosis and requires immediate and continuous medical care.

It was also argued that the continuous incarceration of the applicant, without proper treatment and care being provided by the authorities, infringes upon her basic human rights as well as the fundamental rights enshrined in the Constitution.

Last Hearing

Previously, the High Court had set July 2 to hear the bail application moved by Leena Paulose concerning a money laundering case registered against her under the PMLA.

During the earlier proceedings, Advocates Anant Malik, along with John Paul Edison, had appeared for Leena Paulose.

Her counsels submitted that she had been in jail for a period of three years and seven months, and that charges had not been framed even as of now.

Referring to Section 45 of the PMLA, they argued that the proviso to Section 45(1) provides relaxation for women.

It was further argued that other co-accused in the present case, particularly Pinki Irani and Jacqueline Fernandez, had already been granted bail by the court. It was also contended that Avtar Singh Kochar had been granted bail by placing reliance on the Supreme Court's judgment in the Manish Sisodia case.

In September 2021, Paulose was arrested concerning a Rs 200 crore extortion case registered by the Economic Offences Wing (EOW) of Delhi Police against her.
