Delhi HC Issues Notice to Police on Ex-AAP MLA Naresh Balyan’s Bail Plea in MCOCA Case

The Delhi High Court yesterday issued notice on the bail plea filed by former Aam Aadmi Party (AAP) MLA Naresh Balyan, booked under the Maharashtra Control of Organised Crime Act (MCOCA) in a case linked to an alleged crime syndicate led by gangster Kapil Sangwan alias Nandu.
A bench led by Justice Manoj Jain heard the matter. The bench sought a status report from the Delhi Police on Balyan’s plea seeking regular bail as well as his separate plea for interim bail on medical grounds.
Presently, Balyan has been in custody since December 4, 2024, following his arrest in connection with the MCOCA case.
The court also directed the jail authorities to submit a medical report on Balyan’s current condition, in light of his request for interim relief on health grounds.
Appearing for Balyan, Senior Advocate Sunila Dalal, along with Advocates Vivek Jain and Rohit Kumar Dalal, argued that the investigation is complete and a charge sheet has already been filed.
On the other hand, Special Public Prosecutor (SPP) Amit Prasad appeared for the Delhi Police.
Earlier, the Rouse Avenue Court had dismissed the bail plea of former Aam Aadmi Party (AAP) MLA Naresh Balyan in a case registered under the Maharashtra Control of Organised Crime Act (MCOCA).
Special Judge Dig Vinay Singh of Rouse Avenue Court had rejected Balyan’s second bail application, observing that there was no change in circumstances warranting relief.
Background
Previously, Balyan had withdrawn his bail appeal from the Delhi High Court on May 7. On May 5, the Court had taken cognisance of a supplementary charge sheet naming Balyan and three others as accused.
The Court had directed daily hearings on charge framing from June 3 and extended the judicial custody of all accused. The Delhi Police had been asked to expedite the probe concerning another accused, Vikas Gehlot.
