Delhi HC Seeks Centre’s Response On Plea To Cut GST On Air Purifiers Amid Pollution Crisis

Delhi High Court has sought the Centre’s response on a plea seeking reduction of GST on air purifiers amid worsening air pollution in the national capital.

The matter was taken up on today to enable the Centre to inform the Court about the timeline for the GST Council meeting and to clarify whether a virtual meeting could be held if a physical meeting was not immediately possible.

The Delhi High Court on Friday, December 26, 2025, considered a public interest plea seeking a reduction in the goods and services tax on air purifiers amid worsening air quality in the national capital, and directed the Union government to file a detailed response.

The petition, filed by advocate Kapil Madan, urged the Court to direct the Centre to classify air purifiers as “medical devices” and bring them under the five per cent GST slab. At present, air purifiers attract GST at the rate of 18 per cent.

The plea argued that such devices cannot be treated as luxury items in the face of what it termed an extreme public health emergency caused by hazardous pollution levels in Delhi.

A vacation Bench comprising Justices Vikas Mahajan and Vinod Kumar granted the Centre ten days’ time to place its reply on record and listed the matter for further hearing on January 9.

During the proceedings, counsel appearing for the Union government informed the Court that meetings of the GST Council are required to be held in physical mode and that convening the Council through video conferencing is not feasible.

Additional Solicitor General N. Venkataraman, appearing for the Centre, sought time to file a comprehensive affidavit in response to the plea.

The Court had earlier, on December 24, directed the GST Council to convene at the earliest to examine the issue of reducing or abolishing GST on air purifiers.
