The Delhi High Court today allowed an application of Swami Chakrapani in a plea seeking direction to the Election Commission of India to allow the office bearers of Akhil Bharat Hindu Mahasabha and its President Swami Chakrapani to contest Assembly elections in several states .

The Division bench of Chief Justice DN Patel and Justice Jyoti Singh has listed the matter for next hearing on September 6.

Earlier the Division bench of Chief Justice DN Patel and Justice Prateek Jalan had issued notice to the Election Commission of India on Chakrapani’s plea challenging the single judge bench order which had dismissed his petition.

The petition was dismissed as misconceived in view of the observations made by the Division bench earlier which had dismissed a petition over the conflict between the party and the Election Commission of India.

The petition seeks directions to the Election Commission to recognize the list of office bearers under the Presidentship of Swami Chakrapani and allow the petitioner and the office bearers of the Akhil Bharat Hindu Mahasabha to participate in the assembly Elections in several states.

The plea states that the Akhil Bharat Hindu Mahasabha is a registered political party certified by the Election Commission of India as is one of the oldest political parties of India. It has been submitted that was first elected as the national president for the party in 2006.

It has further been stated that on November 11, 2020, Chakrapani was recognized as the president of the party by the ECI. However, on January 14, 2011, the Commission withdrew the aforesaid recognition as there were litigations.

Senior Advocate Vikas Singh appeared for Swami Chakrapani.
