Delhi High Court allows Former PFI Chairman E. Abubacker to withdraw plea seeking medical bail

Synopsis

Court was hearing a criminal appeal filed by former PFI Chairman Erappungal Abubacker challenging the Special Judge's order dated November 14, 2022, denying him bail.

The Delhi High Court on Thursday ‘allowed’ former Popular Front of India (PFI) Chairman Erappungal Abubacker, lodged in prison under an Unlawful Activities Prevention Act (UAPA) case, to withdraw his plea seeking release on account of ill health.

During the hearing, Advocate Adit Pujari appeared for Abubacker and sought permission to withdraw the plea, with the liberty to approach the Trial Court, in view of the fact that the National Investigation Agency (NIA) has already filed the chargesheet in the case.

A division bench of Justices Siddharth Mridul and Purushaindra Kumar Kaurav noted, “At this juncture, Mr. Adit Pujari appearing for the appellant, on instructions seeks to withdraw this appeal with liberty to approach Trial Court. In view of circumstances, the chargesheet in relation to the appellant has since been filed”.

The court granted Pujari the liberty to approach the Trial Court for Medical Bail. Accordingly, the court dismissed the plea as withdrawn.

It may be noted that on October 13, Justice Anoop Kumar Mendiratta of the high court dismissed the bail application filed by Abubacker.

Abubacker was arrested on September 22, 2022 in the PFI raids and was initially sent to a 4-day NIA custody.
