Delhi High Court Allows Homeopathic Colleges To Participate in Ongoing Counselling For Academic Year 2020-21

The Delhi High Court has recently has allowed Homeopathic Colleges to participate in the ongoing counselling for taking admissions for the academic year 2020-21. 

A Division Bench of the Delhi High Court comprising the Hon’ble Chief Justice D.N. Patel and Hon’ble Justice Jyoti Singh passed the said order in an appeal filed by one of the Homeopathic College situated in the State of Madhya Pradesh against the order of Hon’ble Single Judge, wherein the Hon’ble Single Judge on 01.02.2021 declined to grant interim relief in the writ petition.

The instant writ petition was filed against the order passed by Ministry of AYUSH denying the permission to the College for taking admissions in Homeopathic courses for the academic year 2020-21.

The Appeal mentioned that, “ the Appellant is a self-financed unaided private Homeopathic college which was established in the year 2001 and thus, conducting undergraduate programs pertaining to BHMS course with intake capacity of 100 UG seat.

It is pertinent to note that the Appellant College was granted permissions in previous years on the basis of same sets of the employees for 100 seats but same is being denied for this academic session on frivolous grounds.”

The writ petition and appeal had been filed before Hon’ble Delhi High Court by a team of Fiducia Legal comprising of Mr. Animesh Kumar & Nishant Kumar (Partners), Akash Chatterjee & Utkarsha Sharma (Associates) who were led by the Mr. Nidhesh Gupta, Sr. Advocate.
