Delhi High Court directs Delhi Govt to treat as representation plea for complete waiver of Board Examination Fees for Class X and XII

The Delhi High Court has directed the Directorate of EducationDelhi Government and Central Board of Secondary Education (CBSE) to treat as representation a plea seeking complete waiver of examination fee for students of class X and XII studying in Delhi Government Schools and in Economically Weaker Sections Category of the private schools for the current academic year 2021-2022.

The Single Judge bench of Justice Prateek Jalan passed the order while hearing a plea seeking directions to the Directorate of Education, Government of NCT to extend financial co-operation to the Class X and XII students  by paying the Board exam fees as sought by CBSE vide circular dated September 16, 2021.

On the court’s observation that the  question of whether to provide subsidy to Government school students in respect of the Board examination fees is a matter of policy and it is the Government which must take a call, Advocate  Pulkit Agarwal appearing for the petitioner, therefore sought permission to withdraw the writ petition with liberty to make a representation to the respondents.

The court accordingly directed GNCTD and CBSE to treat the writ petition as a   representation and take a policy decision thereupon.

The court further said that as the last date for submission of the examination fees for the Board examinations to be held in 2022 is September 30, 2021, “if the GNCTD intends to provide the relief sought by the petitioner, it is directed to issue a public notice to this effect by 29.09.2021”.
