Delhi High Court directs MCD to not withhold salaries of Paramedical staff at RBIPMT and MVID hospitals till Oct 28

Court considered the fact that many employees of the Paramedical Technical Staff Welfare Association are uneducated, and do not own smartphones, which causes difficulties for them to mark their attendance using the App.
Justice Rekha Palli of the Delhi High Court has directed the Municipal Corporation of Delhi (MCD) to ensure that the salaries of the employees of the Paramedical Technical Staff Welfare Association are not withheld until the next date of hearing i.e. October 28, as they are unable to mark their attendance in the MCD SMART App via a smartphone.
The court was hearing a petition filed by the Paramedical Technical Staff Welfare Association of MCD challenging a communication issued by the MCD on August 18, 2022, in which it directed that salaries of all paramedical staff at the RBIPMT and MVID hospitals would be released only after they marked their attendance via the MCD SMART App via smartphones.
The counsel for the petitioner contended that the impugned order of MCD was issued without taking into account the fact that many of the employees of the Welfare association are uneducated and do not own smartphones, making it impossible for them to mark their attendance using the MCD SMART App.
Court noted that despite advance service and the matter being passed over, none appeared for MCD and no explanation could be sought from the MCD as to why the employees of the Welfare association’s attendance could not be marked by any other mode during the interregnum until they can purchase smartphones and are provided with the necessary training to operate the MCD SMART App.
Court ordered MCD to ensure that the salaries of the employees of the Welfare Association are not withheld until the next date because they are unable to mark their attendance in the MCD SMART App using a smartphone. Court posted the matter on October 28, 2022 for further hearing.
