Delhi High Court Dismisses Plea Seeking Ban On Sale Of Fake ISI Helmets

“The complaint made to the Bureau of Indian Standards was an incomplete complaint which was, therefore, non-actionable”, the court added. 

On Friday, the Delhi High Court dismissed a plea that sought directives against the Director General of the Bureau of Indian Standards for apprehending vendors selling counterfeit or unmarked ISI helmets. The bench, comprising Acting Chief Justice Manmohan and Justice Tushar Rao Gedela, expressed frustration with the petition's structure and composition.

The court interrogated the lawyer Ullhas, who had submitted the petition, regarding his comprehension of such legal documents. The court pointed out that his petition was replete with grammatical errors and lacked coherent form and structure.

The lawyer argued that he had made a representation to the bureau, but no action was taken. The court observed that the representation was deficient in specific details, such as the names and addresses of the vendors, rendering it unactionable.

Consequently, the Delhi High Court dismissed the plea and instructed the lawyer to resubmit his representation with properly structured documents that include the names of sellers of non-ISI or fake ISI helmets.
