The Delhi High Court has granted bail for three weeks to an accused to enable him to take care of his pregnant live-in partner. He and his live-in partner were booked by the Delhi Police earlier this year for possession of fake identity cards of RAW and IB.
Justice Poonam A Bamba ordered the release of the accused on interim bail subject to his furnishing a personal bond in the sum of Rs 30,000 with one surety of the like amount. The application of the accused’s regular bail, who has been in custody since January, is pending before the court.
Justice Poonam Bamba observed that considering that except for the woman's grandparents, who are in their nineties, there is no one to take care of the co-accused/live-in partner of the applicant/accused, the applicant/accused should be admitted to interim bail.
The accused had sought eight weeks bail to allow him to take care of the co-accused, who was in an advanced stage of pregnancy. The court was told that there is no one to take care of her and her 95-years-old grandparents, who have come from Assam.
Background
The couple was sent to jail for allegedly possessing fake IDs of RAW and the Intelligence Bureau. A Scorpio car with stickers of the agencies was found parked outside by the police. While examining the car which was parked outside their flat, the special cell found that the woman was in possession of two fake ID cards.
The designation on the ID cards were "Cybersecurity and Law Expert" for RAW and "Anti-terrorist Squads" on the card for IB. The woman was granted bail in April due to her pregnancy.
Justice Bamba observed that "since the accused's mother is presumed to be innocent until proven guilty, her child to be born must also see the world as a free citizen rather than from behind bars with his/her mother".
While the court granted bail to the accused this time, on account of taking care of his pregnant partner, it had rejected all previous claims as the offences were of a serious nature and a threat to national security.
