Delhi High Court Grants Dynamic Injunction Against Websites Illegally Streaming Stranger Things

The suit, the plaintiffs stated, was filed against Defendant Nos. 1 to 47 piracy websites which are primarily engaged in online piracy by providing illegal access to copyrighted content through streaming and downloads

The Delhi High Court has recently granted a ‘Dynamic+ injunction’ in favour of Warner Bros, Netflix, Apple, Disney and Crunchyroll, while directing the blocking of several websites found to be illegally hosting pirated films and television shows such as Stranger Things, Friends, Batman, Squid Game, The Jungle Book and others.

The order was passed by Justice Tejas Karia in a suit filed by the entertainment companies seeking a permanent injunction against multiple piracy websites.

The plaintiffs approached the Court alleging that the websites were infringing their exclusive copyright by making original films and series available for streaming, downloading, uploading and reproduction without authorisation.

Finding that the plaintiffs had made out a strong case for immediate relief, the Court observed, “The Plaintiffs have made out a prima facie case for grant of an ex-parte ad-interim injunction. Balance of convenience is in favour of the Plaintiffs and against the Infringing Websites. Irreparable injury would be caused to the Plaintiffs if an ex-parte ad-interim injunction is not granted. The need for immediate relief is particularly pressing in this case as the Infringing Websites are making available the Plaintiffs’ Copyrighted Works, which could lead to significant financial losses for the Plaintiffs.”

Highlighting the manner in which piracy websites frequently resurface under new names or links, the Court observed, “To keep up with the hydra-headed nature of the infringement actions of such infringing domains or websites, this Court finds it fit to grant a ‘Dynamic+ injunction’ to protect the Plaintiffs’ Copyrighted Works as soon as they are created, to ensure that no irreparable loss is caused to the owners of Copyrighted Works, as there is an imminent possibility of the Plaintiffs’ Copyrighted Works being uploaded on infringing websites or their newer versions immediately thereafter.”

Before the High Court, the plaintiffs submitted that they are members of the Motion Picture Association and or the Alliance for Creativity and Entertainment, and are among the leading global entertainment companies engaged in the creation, production and distribution of motion pictures and cinematographic works. They contended that their copyrighted works fall within the definition of “work” under Section 2(y) of the Copyright Act, 1957.

The plaintiffs further added that take-down notices were issued to the infringing websites on December 5, 2025. However, despite receiving these notices, Defendant Nos. 1 to 47 continued to infringe the plaintiffs’ copyright by hosting and making available their copyrighted works without authorization.

Taking note of these submissions, the Court restrained the infringing websites, along with their owners, operators, employees and anyone acting on their behalf, from hosting, streaming, reproducing, distributing or otherwise making available the plaintiffs’ copyrighted films and series in any manner.

The Court also directed domain name registrars to lock and suspend the infringing websites within 72 hours of being communicated a copy of the order

The registrars have been asked to submit the basic subscriber information of the website owners, including contact details, IP logs and bank information, in a sealed cover within four weeks. Internet Service Providers were similarly directed to block access to the infringing websites identified by the plaintiffs within 72 hours.

The matter will be heard next on 20 April 2026.
