Delhi High Court issues notice to UIDAI in plea seeking protection of Aadhar Infromation from unauthorized access to third party

The Delhi High Court on Wednesday issued notice on a plea seeking directions to Unique Identification Authority Of India (UIDAI) to take appropriate initiatives under the aegis of Aadhar Act, 2016 for the protection of the Aadhar information and privacy of the Citizens of India from unauthorized access to the third party such as Google Pay.

The Division bench of Chief Justice DN Patel and Justice Jyoti Singh issued notices and sought response from UIDAI, Reserve Bank of India (RBI) and Google India Digital Services Private Ltd.

The Court issued notice on a plea filed by Abhijit Mishra through Advocate Payal Bahl.

The petitioner has submitted that the petition highlights “the grave issue of the unauthorized access, use and storing of the Aadhar and banking information of the Citizens of India by the Respondent No. 3 i.e. Google Pay in sheer violation of the Article 21 of the Constitution of India, Aadhar Act 2016, Payments and Settlement Systems Act 2007 and Banking Regulations Act 1949. It is submitted that the Respondent No. 3 i.e. Google Pay in their terms and conditions have specially and explicitly mentioned that Google Pay will collect, store and share the Bank Account or Aadhar details”

The petition seeks a direction to UIDAI to initiate actions against Google Pay under the aegis of Section 29 Section 38 and Section 43 of the Aadhar Act 2016 for collecting, storing and using the Aadhar information of the citizens in the violation of objects of the Aadhar Act, 2016.

Directions have also been sought to UIDAI and  Reserve Bank of India to prevent unauthorized access of the Aadhar and Banking information of the citizens of India in the banking and financial system.
