Delhi High Court orders taking down content of Shah Rukh Khan’s upcoming film Jawan

Synopsis

Court was hearing a copyright suit filed by Red Chillies Entertainment Private Limited, the production house owned by Shah Rukh Khan and Gauri Khan.

The Delhi High Court on Tuesday restrained various platforms including rogue websites, cable TV platforms, and direct-to-home (DTH) services along with John Doe defendants from circulation of the copyrighted content of Shah Rukh Khan’s upcoming film “Jawan”, which is scheduled to release on June 2.

The bench of Justice C. Hari Shankar was hearing a copyright suit filed by Red Chillies Entertainment Private Limited, the production house owned by Shah Rukh Khan and Gauri Khan against the rogue websites and other defendants seeking restraint from broadcasting or airing any part of the film “Jawan”.

The entertainment company alleged that clips and stills from the film are already available on the internet over various platforms, though no licence, to broadcast or transmit any part of the film has, to date, been granted by the plaintiff to any entity.

The court issued summons to the defendants in the copyright suit and also directed YoutTube, Twitter, Reddit, and Google to immediately block and, thereafter, take down all infringing content and the clips referred to in the plaint.

 “The defendants, as well as all others acting on their behalf, are restrained from copying, recording, reproducing, allowing recording, transmitting, communicating or making available for distribution, duplication, display or release, exhibiting or playing in any manner, any stills, audio/video clips, songs, recordings or other proprietary information relating to the cinematographic film "Jawan" or any part thereof without a proper licence from the Plaintiff, through any medium whatsoever”, the single-judge bench ordered.

“Defendants 6 to 40 and all others acting on their behalf are directed to block access to the websites/webpages mentioned in Schedule B to the plaint, as well as any mirror/alphanumeric/redirect website thereof”, it added.

Furthermore, the court granted liberty to Red Chillies Entertainment to immediately intimate Defendants 6 to 40 in that regard. Court said, “Defendants would promptly take down/block access to the said content. This order shall remain in force till the next date of hearing”.

The matter will be heard next on July 7, 2023.
