Delhi High Court rejects plea seeking permission to organize “Maa Bhagwati Jagran” near Anand Vihar ISBT on Nov 12

Justice Yashwant Varma of the Delhi High Court on Friday dismissed a plea seeking directions to grant permission to organize “Maa Bhagwati Jagran” on November 12, at Anand Vihar foot-over-bridge near the in-gate of Anand Vihar ISBT.

Advocate Kamlesh Kumar Mishra appearing for the petitioner association submitted that he had gotten permission from the Municipal Corporation Delhi (MCD), Traffic Police, and other concerned departments, but only the Delhi Police had not responded.

Counsel appearing for MCD contended that permission to conduct the event was given subject to restrictions.

The single-judge bench noted that the event was to be conducted on a “public land”, accordingly, dismissed the petition.

The plea by the association stated that the said Jagrata has been held for several years and its preparation begins months in advance and that the petitioner association had made advance representations to the concerned authorities. Some of the authorities/departments have responded and granted their ‘No objection’ to the event.

“However, the Delhi Police has not responded to the same and based on the organizers’ the petitioner association is concerned that the Police will cause a hindrance in the conduct of the Jagrata, and thus they have approached the High Court”, the plea read.

The petitioner association sought directions to the Delhi Police to ensure the smooth conduct of the Bhagwati Jagran and to make adequate security arrangements for the same.

The plea further stated that last year during the Bhagwati Jagran the local police created a hindrance in the conduct of the event due to no prior intimation given to them, but this year, when prior information has been sent days in advance, they have not replied yet. It is further stated that even the Traffic Police and the Municipal Corporation have granted permission.
