"Difficult To Create Additional Reservation For Transgender": Maharashtra Govt Tells Bombay High Court

Synopsis

The high court suggested that the court could hear the plea after the outcome of the expert committee constituted by the state government.

The Maharashtra Government on Tuesday informed the Bombay High Court that it is difficult for the State Government to create additional horizontal and vertical reservations for transgender in the education and employment sector.

Advocate General Birendra Saraf informed the court that the Central Government had not implemented any guidelines concerning the Supreme Court's judgment of National Legal Services Authority vs Union of India wherein the top court had directed government to make reservations for transgenders.

The high court was also informed that the State Government had created a special committee for considering the issue of reservation for transgenders.

Advocate Kranti LC informed the court that states like Karnataka had made reservations for transgender in employment and the same could be implemented in Maharashtra. 

However, the division bench of Justice Nitin Jamdar and Justice Sandeep V Marne suggested that the courts could be approached after the outcome of the special committee.

The observations were made by the court while hearing a plea filed by an electrical engineer seeking modification of the advertisement issued by the Maharashtra Transco.
