Synopsis

An 80-year-old man challenged family court's order to pay his wife Rs 5,000 monthly maintenance

During a hearing on an alimony case involving a couple aged 76 and 80, the Allahabad High Court recently made an unusual remark.

Justice Saurabh Shyam Shamshery said the situation seemed like "Kalyug" – a time of conflict in Hinduism – and raised concerns about such legal battles.

The case involves Munesh Kumar Gupta, an 80-year-old retired health worker, and his 76-year-old wife, who have been in a property dispute since 2018. After failing to settle the issue with the police and a family counseling center, the couple began living separately.

The wife later filed a case in family court, asking for Rs 15,000 a month in alimony from her husband, who receives a pension of about Rs 35,000.

In February, the court ordered Gupta to pay Rs 5,000, but he challenged this decision in the Allahabad High Court.

During the recent hearing, Justice Shamshery also advised the couple and hoped they could resolve the matter before the next hearing. He issued a notice to the wife as part of the proceedings.

The judge commented that such disputes are troubling and hoped the couple could find a peaceful solution.
