Gujarat HC orders verification and examination of alleged bogus medical certificates issued to aid prisoners in securing bail

Synopsis

Court noted that the doctor who had issued two medical certificates in the name of different hospitals with different addresses also had a criminal history. 

The Gujarat High Court recently ordered verification and examination of the medical certificates issued by a doctor in two bail applications. 

The bench of Justice MK Thakker directed the concerned investigating officers to probe the two certificates issued by a doctor namely Dr. ML Patel under the supervision of the Commissioner of Police, Surat. "...so that, correct and true facts be surfaced on record," court said. 

To the court, in two applications that had been filed seeking temporary bail on the ground of medical treatment, the medical certificate annexed with the pleas appeared bogus. 

Court pointed out that though both the bail applicants had been issued medical certificates by different institutions, the doctor, under whose name they had been issued, was same.

Court noted that in one plea, the medical certificate was issued by Dreamz Multi Speciality Hospital, wherein the name of the doctor was mentioned as Dr. ML Patel, whereas in the connected matter, though the medical certificate was issued by Shree Hari Multi Speciality Hospital, the name and stamp of Dr. ML Patel was affixed on it.

Court further highlighted that in the certificates, the degree of the said doctor was mentioned as MBBS, MRSM(UK) but the trial court, in its order in the matter, had stated that MRSM means Member of the Royal Society of Medicine of the United Kingdom which is not a degree rather the doctor must be having a membership of that institution.

Further, the trial court has pointed out that in one of the bail pleas, the said doctor had issued the certificate advising for surgery, which an MBBS doctor cannot perform, the high court stated.

"It is further observed by learned trial Court that said doctor is in habit of issuing the Medical Certificates in the name of different hospitals i.e. Aarzoo, Shri Hari and Dreamz to aid prisoners for filing applications for bail before Court of law," court underscored. 

Apart from that, court noted that the said doctor also had a criminal history. 

Therefore, while holding that "prima-facie, it transpires that the said doctor namely Mr. ML Patel (Mr. Mahendra L Patel) is issuing such bogus Certificates in the name of different hospitals with different addresses," the high court directed the police to verify and examine the certificates issued by the doctor. 

The matter will be next heard on June 8, 2023.
