Health Is Precious Right: Mumbai Court Allows Jet Airways Founder Naresh Goyal To Attend Private Doctors & Meet His Wife

The Mumbai court has allowed Jet Airways founder Naresh Goyal to attend his private doctors for diagnosis and to meet his bedridden wife.

Special PMLA Judge MG Deshpande, in the order, recorded that health is a precious right, and the Enforcement Directorate (ED) cannot oppose it.

“Health is precious and getting proper treatment is his valuable right. ED cannot oppose the same and can depute their officer in case the accused is taken out of Jail for referring him to his private doctors,” the order states.

The PMLA Court also recorded that Goyal’s wife was suffering from cancer, and his daughter was not well, so it was quite natural to meet his wife in such a situation.

“.. his wife is bedridden, suffering from Cancer. His only daughter is also reportedly not well to look after her mother. In this way, accused and his wife have become orphan. In such situation feeling to meet the ailing wife once is quite natural. No prejudice will be caused to the ED if the same is allowed. Considering this exceptional situation, I am of the opinion that empathy warrants to consider the prayer of accused Mr. Naresh Goyal to meet ends of justice on humanitarian ground,” the order reads.

The Special Court allowed Goyal to meet his wife on 13th January from 10:30 until jail closing hours.

The court allowed Goyal to see a cardiac specialist, a dentist and an orthopedist.

This came after Naresh Goyal broke down in the Special PMLA (Prevention of Money Laundering Act) Court in Mumbai and urged the judge not to provide him with any medical assistance, expressing that he had lost all hope in life and would prefer to die inside the jail.

Goyal informed the court that he is unable to fold both legs and is experiencing significant knee pain due to swelling.

Additionally, he submitted that he frequently needs to rush to the washroom for urination. Nowadays, he is facing severe pain while passing urine, and at times, there is the presence of blood coupled with unsustainable pain.

He urged the judge not to take him to JJ Hospital as it is very troublesome, hectic, and tedious, which he cannot bear and sustain.

Goyal added that whenever he is taken to J.J. Hospital, there is always a long queue of patients, and he cannot reach the doctor in time. Furthermore, whenever he is examined by the doctor, further follow-up is not possible.

“Don’t send him to J.J. Hospital and allow him to die in the jail itself. Now, he has lost every hope of life and better he should die rather keeping him alive in such situation” Judge MG Despande recorded.
