High Court seeks status report from Delhi Police on Sukesh Chandrashekhar’s plea challenging punishment by Jail authorities

Synopsis

Chandrashekhar has prayed to set aside and quash the order of April 17, 2023, passed by the office of the Jail Deputy Superintendent of Prison, Mandoli, as well as stay on the execution of the said order until the adjudication of the present petition. The matter will be heard next on April 28.

The Delhi High Court on Wednesday sought a status report from the Delhi Police on the plea by Sukesh Chandrashekhar challenging the punishment awarded to him by the jail authorities.

Advocate Anant Singh Malik appearing for Sukesh contended, “The challenge is to two Jail tickets issued in violation of Delhi Prison Rules. Rule No. 1272 and 1273, the rules prescribe that a show cause notice should have been issued to me, and then I was supposed to join the inquiry, My Lords!”

The Jail authorities have issued an order stopping Chandrashekhar from using family meetings/phone calls and canteen facilities which is to be effective from May 1 till May 15, 2023.

“These tickets are operative from May 1. My lords! The situation as it stands, I (Chandrashekhar) was never informed about the Jail Tickets. I became aware of these tickets from this letter dated April 17”, Malik submitted.

The counsel stated that the letter had gone to the judge for appraisal who appraised it and after that the jail authorities informed Chandrashekhar. “That's the situation! This is an issue of the principle of natural justice as well. There are no two ways about it because there are judgments of the coordinate benches”, he said.

Furthermore, Malik added, “I am seeking a stay, my lord! Because the letter will become operative on May 1. These are important issues i.e. family mulakat and canteen facilities which will get stopped, my lord!”

Taking note of the submissions, the bench of Justice Dinesh Sharma issued notice to the Additional Standing Counsel (ASC) Nandita Rao and directed her to file a status report in the plea.

“Issues notice. Ms. Nandita Rao standing counsel to file a status report in the plea. The relevant record is also to be put before the court”, the court ordered.

Accordingly, the court listed the matter for further consideration on April 28, 2023.

Chandrashekhar has prayed to set aside and quash the order of April 17, 2023, passed by the office of the Jail Deputy Superintendent of Prison, Mandoli, as well as stay on the execution of the said order until the adjudication of the present petition.

His plea stated that the Jail Deputy Superintendent had arbitrarily, erroneously, and without any application of mind, awarded two punishment tickets against Chandrashekhar depriving him of the canteen facility and the Mulakat/Phone call facility for 15 days.
