[IIT JEE] Bombay HC Directs Chairman To Decide On Complaints Made By Students Regarding Glitches During Online Exam

Synopsis

The High Court took note of the fact that the examination is important to the career and the authority is required to deal with the said grievances and arrive at an independent conclusion as to the grievances made.

A division bench of the Bombay High Court, comprising of Justice S.V Gangapurwala and Justice R.N Laddha, directed the authority, JEE IIT Mumbai, Chairman to decide the complaints of the petitioner as per clause 33 of the information brochure JEE(Advanced) 2022 Examination on or before the 10th September 2022.

The matter pertains to petitions filed by the students, wherein it was alleged that they had faced problems while answering the questions for IIT JEE (Advanced) 2022 exam. The emanations were held in two sessions and students were allowed to appear in both sessions.

It was argued by the advocate of the petitioner that 'the zoom of the questions was 300%' and the questions were not fully appearing on the screen. Candidates had to scroll horizontally and vertically to answer the questions due to which a lot of time was lost and all the students are meritorious. Further, it was argued that complaints were made during the first session so that the same can be rectified in the second session for students to appear. However, no rectification was made by the respondent and most of the time the students were adjusting the mouse and the CBT system collapsed. Further, referring to the clauses of the brochure the respondents were required to give extra time but the same was not given to the petitioners.

The advocate for the respondent argued that only 25 complaints were received out of 1.6 Lakh students who appeared. The complaints were received only on 2nd September and on 3rd September after the provisional answer key was released.

The court before dismissing the complaint noted that as per the clauses of the brochure there is a mechanism for redressing the complaints. Under the clauses, students were allowed to write to the organizing chairman of the JEE advanced for clarification. The decision of the grievance is final and the authority should be experts from the field as per the clauses of the brochure. 

The court before dismissing the petition directed the respondent to decide the complaints under clause 33 of the brochure on or before 10th September 2022. Further, the results may be declared on 11th September 2022 and the Authority shall scrupulously look into the grievances of the Petitioners and arrive at an independent conclusion and communicate the same to the complainants.
